Terms of Use
By using Track My Calories you agree to these terms. They're written to be read, so please do.
1. About the App
Track My Calories (the "App") is provided by Beauco Services Ltd ("we", "us"), a company registered in England and Wales, company number 17476354, registered office 66 Paul Street, London, England, United Kingdom, EC2A 4NA.
2. Who can use it
The App is for adults aged 18 or over, for your own personal, non-commercial use. We give you a free, non-exclusive, non-transferable right to use it on your own devices.
3. Not medical advice
The App, including the calorie budget calculator, gives general estimates only. Calorie needs vary between people and the figures may not be accurate for you. Nothing in the App is medical, dietary or professional advice.
Speak to your GP or a registered dietitian before changing your diet, especially if you are pregnant or breastfeeding, are under medical care, take medication, or have or have had an eating disorder. If tracking food makes you anxious or unwell, please stop using the App and seek support. In the UK, the eating disorder charity Beat offers help at beateatingdisorders.org.uk.
4. Your data and backups
Your data is stored only on your device (see our Privacy Policy). We cannot access or recover it. Clearing browser data, changing device or uninstalling the App can permanently delete it. You are responsible for keeping backups using the Backup feature.
5. Acceptable use
Please don't misuse the App: for example by interfering with or disrupting it or its hosting, trying to gain unauthorised access, or copying, reselling or presenting it as your own.
6. Our rights
The App, its design, code, name and branding belong to Beauco Services Ltd or its licensors. These terms don't transfer any ownership to you. Your own data remains yours.
7. Availability and changes
We provide the App free of charge and "as is". We try to keep it working, but we do not promise it will be uninterrupted, error-free or always available, and we may change, suspend or withdraw it at any time.
8. Our liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded by law. Your statutory rights as a consumer are not affected.
Subject to that, and to the extent permitted by law, we are not liable for loss of data, or for any indirect or consequential loss, arising from your use of or inability to use the App. Because the App is free, you use it at your own risk and our total liability for any other loss is limited to £100.
9. Changes to these terms
We may update these terms from time to time. The "Last updated" date shows when. Continuing to use the App after a change means you accept the updated terms.
10. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, although if you live in Scotland or Northern Ireland you may also bring a claim in your local courts.
